BTG Sues Boyd & Durant Law Firm For Failing to Timely File Client’s Claims Within the Statute of Limitations

Plaza Tower Realty Group, LLC, a real estate brokerage firm, hired law firm Boyd & Durant, P.L. to recover real estate commissions it was owed for securing buyers in a prospective high-rise condominium building in Tallahassee, Florida.
According to the Complaint, Boyd & Durant prepared to take appropriate legal action to recover the unpaid commissions owed to Plaza Tower, but failed to file any claims against the entities that actually received and held Plaintiff’s unpaid commissions within the applicable statute of limitations.
After four and a half years of litigation, Plaza Tower hired another lawyer to do what should have been done from the beginning – add the proper parties to the lawsuit.
Unfortunately, it was too little too late. In November 2019, although a jury found that while Plaza Tower was owed $750,000 in unpaid commissions, the claims failed because they were not filed within the applicable statute of limitations.
Under Florida law, the statute of limitations for initiating a conversion or unjust enrichment claim is four years.
The jury verdict makes clear that Plaza Tower would have recovered at least the $750,000, plus over $430,000 in prejudgment interest accrued, had the suit been filed against the correct defendants within the four year statute of limitations.
Plaza Tower has now retained the Business Trial Group to bring a legal malpractice claim against Boyd & Durant for allegedly missing the statute of limitations.
